What does a labor inspector check and how to prepare?
What does the National Labor Inspectorate most often check?
PIP focuses on three areas: occupational health and safety (training, medical examinations, occupational risk assessment), legality of employment (contracts concluded before being allowed to work, permits for foreigners) and working time and remuneration (records, schedules, overtime). The inspector may inspect the company without notice, at any time of the day or night, if the business is operated at night.
What are the maximum penalties for violations during PIP inspections?
The labor inspector may impose a fine of up to PLN 2,000 (recidivism: up to PLN 5,000). Taking the case to court may result in a fine of up to PLN 30,000. For gross health and safety violations, the inspector issues an order to stop work or activity - which in practice means immediate closure of the plant or production line. Not only the employer is responsible, but every person managing employees.
Is the lack of important medical examinations really a "blocker"?
Yes - allowing an employee to work without current preventive examinations (initial, periodic or control) is a gross violation of Art. 229 of the Labor Code. The inspector issues an immediate order to remove the employee from work. It doesn't matter that "he's going to make an appointment soon" or that the employee has been working for years without health problems - all that matters is a valid medical certificate on file.
What is a "sham civil law contract" and why is it risky?
If a contractor or B2B performs work under supervision, at a designated place and time, the labor court (or inspector) may find that an employment relationship has actually been established. Effects: the need to pay overdue ZUS contributions with interest, payment of holiday allowance, severance pay and overtime. PIP treats "defirmation" as one of the inspection priorities.
What documents must foreigners have for the company to be safe?
The employer must have and keep a copy of the foreigner's valid residence permit and - depending on citizenship - a work permit (type A-E), a declaration of entrusting work or another title authorizing employment. Employment without the required documents is an offense punishable by a fine and the risk of withdrawal of the foreigner's residence permit.
What should proper working time records look like?
Records must be kept individually for each employee and include actual working hours, overtime, holidays, sick leave and other absences. The inspector compares the records with attendance lists, schedules and pay slips - discrepancies are an alarm signal. Registration "at hand" or completed in advance (e.g. always from 8:00 a.m. to 4:00 p.m.) is a serious violation.
